Terms and Conditions of Service for AI Cookbook

Preamble

These Terms and Conditions of Service ("Terms," "T&C," or "Agreement") constitute a legally binding agreement between you, the user ("User," "you," or "your"), and the individual owner and operator of AI Cookbook ("AI Cookbook," "the Platform," "we," "us," or "our"), a service operated from India.

This Agreement governs your access to and use of the AI Cookbook website, applications, and any related services for sharing and discussing AI prompts (collectively, "the Service"). By registering for an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be unconditionally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree with any part of this Agreement, you are expressly prohibited from using the Service and must discontinue use immediately.

1. Definitions

"User-Generated Content" (or "UGC") refers to any and all data, text, prompts, images, videos, comments, or other materials that you post, upload, submit, or otherwise transmit through the Service.
"Platform IP" refers to all intellectual property owned by or licensed to AI Cookbook, including but not limited to the software, source code, object code, user interface, visual design, branding, logos, trademarks, and all documentation and content created by us related to the Service, excluding User-Generated Content.
"Third-Party Services" refers to any services, applications, APIs, or integrations not owned or controlled by us but which are utilized to provide or enhance the Service.

2. Eligibility & User Accounts

2.1. Eligibility: To use the Service, you must be at least 13 years of age, or the minimum age required in your jurisdiction to consent to data processing and to enter into a binding contract. By using the Service, you represent and warrant that you meet these eligibility requirements.
2.2. Account Registration: You agree to provide accurate, current, and complete information during the registration process. This includes your full name and a valid email address. Providing false information may result in the suspension or termination of your account.
2.3. Account Security: You are solely responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2.4. Account Responsibility: You are solely responsible and liable for your UGC and any consequences of posting or publishing it.

3. User-Generated Content (UGC)

3.1. Ownership: You retain all ownership rights, including all intellectual property rights, to the User-Generated Content you create and share on the Service. We claim no ownership over your UGC.
3.2. License Grant to AI Cookbook: To enable us to operate the Service, you grant AI Cookbook a limited, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, cache, reproduce, modify, display, distribute, and publish your UGC. This license is for the sole purpose of operating, developing, and providing the Service (e.g., to display your shared prompts to other users). This license automatically terminates when you delete your UGC or your account, subject to residual backup copies.
3.3. User Representations and Warranties: You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the UGC you submit and that its publication on the Service will not infringe upon or violate the rights of any third party.
3.4. Content Moderation: We are not obligated to monitor UGC. However, we reserve the right to review, screen, or remove any UGC at any time and for any reason, without notice, if it violates these Terms.

4. Acceptable Use and Prohibited Content

4.1. General Prohibitions

You agree not to post, upload, or share any UGC that:

(a) Is illegal, or promotes or facilitates illegal activities.
(b) Infringes on any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party.
(c) Is unlawful, defamatory, libelous, harassing, abusive, fraudulent, obscene, or otherwise objectionable.
(d) Contains viruses, malware, corrupted data, or other harmful, disruptive, or destructive files or code.
(e) Impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity.

As a platform for responsible prompt engineering, you are strictly prohibited from sharing any content, especially prompts, that falls into the following categories:

(a) Prompts for Bypassing AI Safeguards: You may not publish or distribute prompts that are explicitly designed or marketed to circumvent, disable, or bypass the safety filters and ethical guidelines of third-party AI platforms (e.g., text, image, or code generation services). Sharing techniques or specific wording intended to force other platforms to produce content that violates their policies (such as hateful, violent, or sexually explicit material) is forbidden.
(b) Distribution of "Jailbreak" Prompts: You may not use the Platform to share or distribute "jailbreak" prompts. This refers to any prompt or sequence of prompts engineered to coerce a third-party AI model into violating its core operational constraints or ethical programming. Our platform must not be used to disseminate exploitation techniques for other AI services.
(c) Prompts for Malicious or Illegal Content Generation: You are prohibited from sharing prompts that are explicitly designed to instruct a third-party AI to generate content intended to deceive, harm, or facilitate illegal acts. This includes sharing prompts for creating misinformation, generating malicious code (malware, viruses), writing content for phishing schemes, or producing fraudulent documents.
(d) Disrespect for the AI Ecosystem: AI Cookbook exists within a larger ecosystem of AI development and use. You agree not to share any content that encourages or directly facilitates the violation of the terms of service or acceptable use policies of any third-party AI provider (e.g., OpenAI, Google, Anthropic, Midjourney). Promoting methods to abuse other services is a violation of our own Terms.

5. Intellectual Property Rights

5.1. Platform IP: Excluding your UGC, all Platform IP is the exclusive property of AI Cookbook and its licensors.
5.2. User Feedback: If you provide us with any feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and exploit such feedback without any obligation or compensation to you.

6. Third-Party Services

The Service relies upon certain Third-Party Services, including Vercel (hosting), Supabase (database, authentication, storage), Maileroo (email delivery), and Simple Analytics/Umami (analytics). We are not responsible for and make no warranties regarding these third-party services.

7. Service Availability and Modifications

The Service is provided "AS IS" and "AS AVAILABLE". We do not guarantee any level of uptime or service availability. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.

8. Termination

8.1. Termination by Us: We may suspend or terminate your account for any reason, including but not limited to a breach of these Terms.
8.2. Termination by You: You may terminate this Agreement at any time by deleting your account.
8.3. Effect of Termination: Upon termination, your right to use the Service will cease. Provisions that by their nature should survive termination shall survive.

9. Disclaimer of Warranties and Limitation of Liability

9.1. DISCLAIMER OF WARRANTIES: THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2. LIMITATION OF LIABILITY: IN NO EVENT SHALL THE OWNER OF AI COOKBOOK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
9.3. MAXIMUM LIABILITY: OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE SERVICE SHALL BE LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT OF FEES, IF ANY, PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ZERO RUPEES (₹0).

12.1. Entire Agreement: These Terms, with the Privacy Policy, constitute the entire agreement between you and AI Cookbook.
12.2. Severability: If any provision is held to be invalid, the remaining provisions will remain in effect.
12.3. Waiver: Our failure to enforce any right is not a waiver of those rights.
12.4. Assignment: You may not assign this Agreement. We may assign it without restriction.
12.5. Force Majeure: We are not liable for any failure to perform resulting from causes beyond our reasonable control.

13. Modifications to the Agreement

We reserve the right to modify these Terms at any time. By continuing to use the Service after revisions become effective, you agree to be bound by the revised terms.
